SJD Candidates

The Doctor of Juridical Science (SJD) in Environmental Law offered by Pace University's Elisabeth Haub School of Law is a graduate research degree intended to prepare legal scholars to research, publish and teach in the field of environmental law, whether in the United States or elsewhere in the world.

SJD in Environmental Law

Candidates for the SJD work under close faculty supervision to research, write and defend a publishable doctoral dissertation that creates original knowledge about their chosen topics in environmental law. This is a process which requires at least one academic year in residence at Pace Law, although it may take two to three years or even longer.

Admission to the SJD program is competitive and highly selective. Ordinarily, only one new candidate is admitted each year. A primary consideration in the admission of each new SJD candidate is whether a suitable faculty supervisor is available to supervise that particular candidate for the duration of his or her SJD program.

Before enrolling, SJD candidates should have completed substantial graduate coursework in environmental law, and ideally a full LLM degree in environmental law, either at Pace Law or at a comparable institution. A candidate who does not hold an LLM in environmental law may be admitted on condition that he or she complete 24 credits in environmental law subjects, with at least a 3.0 GPA, before progressing to the dissertation stage of the SJD program.

Dissertation:
A Comparative study on Plaintiff of Environmental citizen suits in United States and China. 
Huishihan’s dissertation aims to the comparison between the plaintiffs in environmental citizen suits, environmental NGOs in United States and China, including the evolutionary history, current situation, and strategies in the lawsuits. Further to discuss how Chinese procuratorates, a new type of plaintiff of environmental citizen suits in China, fill gaps in lacking effects in Chinese environmental NGOs citizen suits.

Maria Antonia Tigre

Maria Antonia Tigre is the Deputy Director for Latin America for the Global Network for the Study of Human Rights and the Environment (GNHRE) and an S.JD. student at the Elisabeth Haub School of Law at Pace University. She is the author and co-author of publications on themes related to Latin American, regional, and international environmental law. Ms. Tigre has previously worked in the private sector and at the World Resources Institute (WRI). She was previously a senior attorney at the Environment Program of the Cyrus R. Vance Center for International Justice, where she provided pro bono legal services to NGOs across the globe, especially in issues related to protected areas and the interface between human rights and the environment. Ms. Tigre is a member of the IUCN World Commission on Environmental Law.

Research Interests: 
Her current research specifically focuses on issues concerning environmental rights and the reshaping of the existing framework of international environmental law. Her book, 'Gaps in International Environmental Law: Toward a Global Pact for the Environment,' was recently published by ELI press. Originally from Brazil, she also researches environmental protection of the Amazon ecosystem, with an emphasis on regional cooperation. Her first book, ‘Regional Cooperation in Amazonia: A Comparative Environmental Law Analysis,’ was published in 2017. She also gave a TEDx talk on the subject.

Research Interests-
International Environmental Law focusing on biotechnology and its implications on the Convention on Biological Diversity and its protocols of Cartagena and Nagoya. Also, the interlinkages of these issues with the World Trade Organization’s General Agreement on Tariffs and Trade and Technical Barriers to Trade Agreement. 
Comparative Environmental Law aiming forest regulations (e.g. Brazilian Forest Code and United States Farm Bill Conservation Programs) in order to identify positive and negative lessons learned to create and implement feasible low carbon policies in farmlands.

Disertation Background- 
The dissertation concerns the socio-economic considerations of living modified organisms (LMOs) as a voluntary instrument of the Cartagena Protocol and its impacts on trade. Given that socio-economic considerations of LMOs, stated on article 26 of Cartagena Protocol, currently presents conceptual vagueness, its application to international public and private trade relations and rules, which require precision, can generate legal uncertainty and disagreement. In this analysis, I argue whether the enactment of SEC legal international or national requirements, based on today’s negotiations within the scope of the Convention on Biological Diversity, conflicts or not with World Trade Organization rules and how it can successfully provide environmental protection and social justice, avoiding its use for just discriminatory green protectionism.
