The American legal system is in the final stages of a legal sex change. From legal sex located in the physical body, it is now, for a growing number of purposes, located in the gendered mind. Legal sex was understood, until around mid-twentieth century, as physical sexual difference between males and females. By 2022, the overwhelming trend in U.S. law is toward framing legal sex as gender identity—defined as “an individual’s own internal sense of whether they are a man, a woman, or nonbinary.”

Professor Noa Ben-Asher, the James D. Hopkins Professor of Law for 2021-2023, will discuss this dramatic transformation in American law and culture and explain why it is urgent to name and assess it. Professor Ben-Asher will also show how current legal battles about gender identity relate to broader legal, political, and social debates about sexual morals in the United States, especially in light of the recent dramatic decision of the Supreme Court to overrule Roe v. Wade. 

ABOUT THE LECTURE
The James D. Hopkins Professor of Law is an endowed chair held by a distinguished member of the faculty for a two-year term in recognition of outstanding scholarship and teaching and honors Judge James D. Hopkins, Interim Dean of the Law School (1982–1983).
